KASAMBAHAY LAW











The Federation of Free workers (FFW) together with different representatives from Migrant Forum Asia (MFI), International Labor Organization (ILO), Visayan Forum, and other concerned groups held a National Workers and Civil Society Consultation on the Implementing Rules and Regulation of the Kasambahay Law last April 15, 2013 at Eurotel Pedro Gil Ermita, Manila.

The Kasambahay Law or the Republic Act 10361 institutes policies that will give protection and welfare to any domestic workers in the country.   The highlight of the said law is that the kasambahay deserves to have access to basic education, decent lodging, privacy in the workplace, right to have enough rest, and weekly day offs. The rights and the privileges of the kasambahay includes the standard treatment  states that the kasambahay shall not subjected to any domestic violence or abuse.  Also the access to outside communication is also included to the rights of the kasambahay in their free time or when it is their day off.  That in case of emergency the access to outside communication shall be granted even during worktime.
Atty. Sonny Matula, President of FFW formally initiated the program with his welcome remarks and was immediately followed by the introduction of participants.  

The brainstorming workshop was divided into four groups which was spearheaded by different chairpersons.  The chairperson for the application of Core Labor Standards was Mr. Tony Asper (FFW), for Coverage and Pre-employment was Mr. Ramon Certeza (TUCP), for Terms and conditions of employment was Mr. Mata (APL) and for Post-employment, Rescue and Grievance mechanisms was Ms.Cabatingan (TUCP-ITUC).

The workshop’s primary objective is to come up with recommendations on how to improve the implementing Rules and Regulations of RA 10361 or the Kasambahay Law. After the group discussions, there were two inputs generated from the participants. First was suggestions on how to apply, ensure and monitor compliance with general standards, including monitoring mechanisms that should be undertaken, and second was to know what are the complementary programs or regulations that be enacted and implemented by government agencies, both at the national and local levels.

After the workshop, the representative from different groups reported the data or the recommendations that their group come up during the workshop. The highlights of the reporting is that the focus of the improvement of the kasambahay law is on the part of the rights of education and training. The of the recommendation raised is the kasambahay should attend the alternative learning system (ALS) or the formal education. This law is subjected for another round of review for further improvement.

MAY KARAPATAN ANG KASAMBAHAY KO!!!
Ang kasambahay o mas kilala sa sinasabi ng marami na katulong ay an gang mga taong may malaking gampanin ating bahay o sa ating bansa. Nakikita lamang natin sila sa tuwing tayo ay may kailangan. Pinapadali nila ang lahat sa tuwing tayo’y gumagalaw sa bahay.
                Itinuturing natin na kamag-anak o kadugo na natin ang mga kasamaabahay. Pero ang masakit na katotohanan ay hindi lahat ng mamamayan ay itinuturing na tao rin ang mga kasambahay, na may karapatan din sila sa mga pangunahing pangagailangan ng tao para mabuhay.
                Ang mga sumusunod ay karapatan ng mga kasambahay na dapat ay nabibigay natin sa kanila.
·         Karapatang makapag-aral
·        Karapatang magkaroon ng araw ng pahinga
·         Karapatang makausap ang mga mahal niya sa buhay
Ilan lamang iyan sa mga karapatan ng bawat kasambahay na hindi kadalasaang nasusunod ng mga amo nila.
